Det \u00e4r v\u00e4lkommet.&nbsp;<\/span><span data-ccp-props=\"{}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">V\u00e5ra erfarenheter inom offentlig upphandling visar att de flesta utmaningar g\u00e5r att l\u00f6sa i <a href=\"https:\/\/www.kompetensforetagen.se\/2020\/10\/domanders-hoppas-pa-mer-vardsamverkan\/\" target=\"_blank\" rel=\"noopener noreferrer\">dialog och samverkan mellan upphandlande regioner och tj\u00e4nsteleverant\u00f6rer<\/a>. Det har inte minst visat sig under coronakrisen. I en anda av prestigel\u00f6shet och samf\u00f6rst\u00e5nd har f\u00f6retag, medarbetare, regioner, politiker och tj\u00e4nstem\u00e4n str\u00e4ckt sig till det yttersta f\u00f6r att undvika l\u00e5sningar och ist\u00e4llet gemensamt svarat upp mot patienters och medborgares behov. Den andan och samf\u00f6rst\u00e5ndet beh\u00f6ver ta med oss in i framtida relationer och avtal.<\/span><span data-ccp-props=\"{}\">&nbsp;<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span data-contrast=\"auto\">Viktigt med \u00f6versyn av karensregler f\u00f6r inhyrning av v\u00e5rdpersonal<\/span><\/h3>\n\n\n\n<p><span data-contrast=\"auto\">En f\u00f6ruts\u00e4ttning f\u00f6r att avtal inom offentlig upphandling ska fungera med kvalitet, kostnadseffektivitet och leveranss\u00e4kerhet \u00e4r att avtalsvillkoren diskuteras mellan de upphandlande parterna. Ett av de villkor som \u00e4r i tr\u00e4ngande behov av diskussion \u00e4r just\u00a0karenstidsregler. Dessa medf\u00f6r att arbetstagare som tar anst\u00e4llning i ett privat v\u00e5rdf\u00f6retag eller ett privat bemannings- eller kompetensf\u00f6retag som levererar v\u00e5rdtj\u00e4nster inte kan jobba inom\u00a0hela\u00a0\u201dsin\u201d region p\u00e5 6\u201312 m\u00e5nader. Regionerna menar att villkoren f\u00f6r karenstid har inf\u00f6rts f\u00f6r att minska risken att f\u00f6rlora medarbetare och f\u00e5 h\u00f6gre l\u00f6nekostnader.\u00a0\u00a0<\/span><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><span data-contrast=\"auto\">Det finns dessutom tveksamheter kring karenstidens f\u00f6renlighet med upphandlings- och arbetsr\u00e4tten<\/span><\/p>\n<\/blockquote>\n\n\n\n<p><span data-contrast=\"auto\">Men en annan sida av myntet \u00e4r att karenstidsreglerna <\/span><span data-contrast=\"auto\">inverkar negativt p\u00e5 v\u00e5rdyrkenas attraktivitet och regionernas arbetsmarknader. V\u00e5rdpersonalens m\u00f6jligheter till att fritt v\u00e4lja arbetsgivare och f\u00f6retagens m\u00f6jlighet att leverera efterfr\u00e5gade tj\u00e4nster leder i f\u00f6rl\u00e4ngningen till brister i v\u00e5rdkvaliteten.<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">Med mer dialog och samarbete<\/span><span data-contrast=\"auto\">,<\/span><span data-contrast=\"auto\">&nbsp;utan karensregler, kan detta motverkas.&nbsp;<\/span><span data-ccp-props=\"{}\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">Det finns dessutom tveksamheter kring karenstidens f\u00f6renlighet med upphandlings- och arbetsr\u00e4tten. D\u00e4rf\u00f6r har advokatbyr\u00e5n Moll&nbsp;<\/span><span data-contrast=\"auto\">Wend\u00e9n<\/span><span data-contrast=\"auto\">&nbsp;enligt uppdrag utrett fr\u00e5gan. Deras promemoria pekar p\u00e5 ett par problem:<\/span><span data-ccp-props=\"{}\">&nbsp;<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span data-contrast=\"auto\">Karenstidsvillkor kan strida mot de grundl\u00e4ggande principerna om offentlig upphandling <\/span><span data-ccp-props=\"{&quot;134233279&quot;:true}\">&nbsp;<\/span><\/li>\n\n\n\n<li><span style=\"background-color: transparent; font-size: 1rem;\" data-contrast=\"auto\">Karenstidsvillkor framst\u00e5r som ett dolt anst\u00e4llningsvillkor som har likheter med s\u00e5v\u00e4l konkurrensklausuler som v\u00e4rvningsklausuler, och d\u00e4rmed kan f\u00e5 samma effekt som v\u00e4rvningsklausuler.&nbsp;<\/span><\/li>\n\n\n\n<li><span data-contrast=\"auto\">Karenstidsvillkor strider mot EU-prim\u00e4rr\u00e4ttens best\u00e4mmelser om etableringsfrihet, fri r\u00f6rlighet f\u00f6r arbetstagare och fri r\u00f6rlighet f\u00f6r tj\u00e4nster&nbsp;<\/span><span data-ccp-props=\"{&quot;134233279&quot;:true}\">&nbsp;<\/span><\/li>\n<\/ul>\n\n\n\n<p><span data-contrast=\"auto\">Karenstidsvillkor riskerar \u00e4ven att strida mot diskrimineringsr\u00e4tten, d\u00e5 den sl\u00e5r h\u00e5rt mot de kvinnodominerade yrkena sjuksk\u00f6terskor och v\u00e5rdbitr\u00e4den.<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-ccp-props=\"{}\">&nbsp;<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span data-contrast=\"auto\">B\u00e4ttre finna konstruktiva l\u00f6sningar<\/span><\/h3>\n\n\n\n<p><span data-contrast=\"auto\">Vi har f\u00f6rst\u00e5else<\/span><span data-contrast=\"auto\">&nbsp;<\/span><span data-contrast=\"auto\">f\u00f6r&nbsp;<\/span><span data-contrast=\"auto\">att det finns en stor press p\u00e5 regionerna att&nbsp;<\/span><span data-contrast=\"auto\">rekrytera<\/span><span data-contrast=\"auto\">&nbsp;och beh\u00e5lla personal. Men vi \u00e4r s\u00e4kra p\u00e5 att det finns mer konstruktiva l\u00f6sningar \u00e4n de som nu ligger&nbsp;<\/span><span data-contrast=\"auto\">f\u00f6r handen<\/span><span data-contrast=\"auto\">.
