Men det finns m\u00e5nga regelverk att h\u00e5lla reda p\u00e5. Kompetensf\u00f6retagens f\u00f6rbundsjurist Mia Fransson g\u00e5r igenom regelverken som alla rekryterare b\u00f6r ha koll p\u00e5.<\/p>\n\n<p>AI f\u00f6r\u00e4ndrar arbetsmarknaden. Det g\u00e4ller inte minst hur rekryteringsbranschen arbetar och hur f\u00f6retag rekryterar. R\u00e4tt anv\u00e4nd kan tekniken effektivisera urval och screening, minska administration och bidra till mer objektiva bed\u00f6mningar. Samtidigt inneb\u00e4r AI nya os\u00e4kerheter, s\u00e4rskilt kring transparens, diskriminering och r\u00e4ttss\u00e4kerhet i rekrytering.<\/p>\n\n\n\n<p>Sedan 2024 g\u00e4ller EU:s <a href=\"https:\/\/www.digg.se\/kunskap-och-stod\/eu-rattsakter\/ai-forordningen\">AI-f\u00f6rordning <\/a>som svensk lag. Reglerna i AI-f\u00f6rordningen b\u00f6rjar g\u00e4lla vid olika tidpunkter:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Fr\u00e5n februari 2025 finns f\u00f6rbud mot att manipulera kandidater, g\u00f6ra social scoring eller k\u00e4nsloanalys av dem. <\/li>\n\n\n\n<li>Fr\u00e5n februari 2025 uppst\u00e4lls \u00e4ven krav p\u00e5 arbetsgivaren att se till att anst\u00e4llda har den AI-kunskap som kr\u00e4vs anv\u00e4ndningen av AI p\u00e5 arbetsplatsen.<\/li>\n\n\n\n<li>Fr\u00e5n 2027 klassas rekrytering som ett h\u00f6griskomr\u00e5de d\u00e5 det kan p\u00e5verka enskilda personers r\u00e4ttigheter och enskildas tillg\u00e5ng till arbete. Det inneb\u00e4r sk\u00e4rpta krav p\u00e5 transparens, m\u00e4nsklig kontroll, loggar och dokumentation samt information till anst\u00e4llda och facket om AI-verktygets inf\u00f6rande.<\/li>\n<\/ul>\n\n\n\n<p>Andra regelverk som f\u00e5r stor p\u00e5verkan vid AI-anv\u00e4ndningen i rekrytering \u00e4r <a href=\"https:\/\/www.kompetensforetagen.se\/dataskyddsforordningen-gdpr\/\">GDPR<\/a> och diskrimineringslagen. Arbetsgivare som rekryterar m\u00e5ste s\u00e4kerst\u00e4lla att AI inte leder till oavsiktlig diskriminering och att uppgifterna som behandlas f\u00f6ljer GDPR.<\/p>\n\n\n\n\n<a class='Share__link Arbetsgivaren och det rekryterande bolaget har fortfarande ett ansvar f\u00f6r beslutet. AI kan f\u00f6rst\u00e4rka befintliga f\u00f6rdomar bl a om den tr\u00e4nas p\u00e5 partisk och snedvriden data. Men det kr\u00e4ver tydliga rutiner, utbildning, transparens och f\u00f6rst\u00e5else f\u00f6r befintlig lagstiftning. Rekryterarens roll blir mer komplex men ocks\u00e5 desto viktigare \u2013 det kr\u00e4vs b\u00e5de teknisk f\u00f6rst\u00e5else och m\u00e4nskligt omd\u00f6me. H\u00e4r \u00e4r v\u00e5r checklista till dig som ska genomf\u00f6ra rekryteringar:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Informera kandidater om AI-anv\u00e4ndning, syfte och r\u00e4tt till manuell granskning.<\/li>\n\n\n\n<li>M\u00e4nsklig kontroll: Alla beslut som p\u00e5verkar anst\u00e4llning ska granskas av en m\u00e4nniska.<\/li>\n\n\n\n<li>Loggning och dokumentation: Spara data, beslut och loggar minst 6 m\u00e5nader.<\/li>\n\n\n\n<li>Bias-test och r\u00e4ttvisa: Kontrollera och \u00e5tg\u00e4rda snedf\u00f6rdelningar i urvalet.<\/li>\n\n\n\n<li>Dataskydd: Genomf\u00f6r DPIA (konsekvensbed\u00f6mning) och f\u00f6lj GDPR.<\/li>\n\n\n\n<li>Utbildning: S\u00e4kerst\u00e4ll att alla som anv\u00e4nder AI har tillr\u00e4cklig kunskap. Enkla automatiseringar, som anv\u00e4nds utan att p\u00e5verka beslut eller riskera att p\u00e5verka en enskilds r\u00e4ttigheter omfattas inte av AI-f\u00f6rordningens krav. Det kan te x vara bokningsverktyg som schemal\u00e4gger intervjuer, mejlmallar eller p\u00e5minnelser. Beslut som fattas helt av m\u00e4nniskor eller system som bara visar data omfattas inte heller av AI-f\u00f6rordningens krav.<\/em><\/p>\n\n\n\n<p><strong>Vilka AI-l\u00f6sningar \u00e4r f\u00f6rbjudna?<\/strong><\/p>\n\n\n\n<p><em>Det \u00e4r f\u00f6rbjudet att anv\u00e4nda AI som manipulerar kandidaters beteende, g\u00f6r social scoring, anv\u00e4nder biometrisk kategorisering (t.ex. f\u00f6r att h\u00e4rleda religion eller sexuell l\u00e4ggning) eller k\u00e4nsloigenk\u00e4nning (t.ex. analys av ansiktsuttryck eller tonfall).<\/em><\/p>\n\n\n\n<p><strong>N\u00e4r \u00e4r AI i rekrytering h\u00f6grisk?<\/strong><\/p>\n\n\n\n<p><em>Automatiserad CV-screening, matchning och AI-st\u00f6d som p\u00e5verkar anst\u00e4llningsbeslut \u00e4r h\u00f6grisk. Det kr\u00e4vs d\u00e5 bl.a. m\u00e4nsklig \u00f6vervakning, transparens mot kandidater, riskhantering och loggning. AI som bara anv\u00e4nds som ett st\u00f6d f\u00f6r att skriva platsannonser \u00e4r inte h\u00f6grisk.<\/em><\/p>\n\n\n\n<p><strong>Vilka lagar g\u00e4ller?<\/strong><\/p>\n\n\n\n<p><em><strong>AI-f\u00f6rordningen: <\/strong>Reglerar AI-system, s\u00e4rskilt h\u00f6griskomr\u00e5den som rekrytering.<\/em><\/p>\n\n\n\n<p><em><strong>GDPR:<\/strong> G\u00e4ller all personuppgiftsbehandling.
